If you sell disposable vapes in Florida, you should be aware that the Florida Vape Registry is now in place and the state hosts a list of products that are banned from being sold. This resource page is for any individual or business that sells vapes in Florida. It is not intended as legal advice but designed to help you navigate Florida's unique Nicotine Dispensing Device Directory (NDD Directory)

The Florida Nicotine Dispensing Device Directory and the legal language that governed its formation sought to fix flaws in the FDA's PMTA process and maintain some level of adult access to alternative nicotine products. 

We have provided the list below and will update it when notified. This resource page for wholesale vape customers has also outlined the punishments and criteria supposedly used to identify products to be banned. This is not a definitive version, that is to be found on the actual Florida website. This feature article is not legal advice.

The Florida NDD Directory Is Not Another PMTA Registry

Rather than the typical registry, which includes a half dozen expensive vapes made by the tobacco industry, the Attorney General operates a website which lists barred products.

The law directs the state’s Department of Legal Affairs to develop and maintain a directory listing all single-use nicotine vapes it deems attractive to minors. The Attorney General's Office must make the list publicly available on Jan. 1, 2025, and regularly update it.

Who Are Decides Which Vape Products Banned?

The law empowers the Florida Attorney General’s Office rely on several sources to create the Florida Vape Ban List. These included harm reports, complaints, surveys and other data sources indicating underage abuse to determine if a device should be listed on the nicotine dispensing device directory. The law focuses primarily on underage use:

• Is designed to be attractive to minors, such as using bright colors or cartoon characters.
• Is designed so that it is easy for minors to use and to conceal.
• Uses or resembles the trade dress of a branded food product, consumer food product, or logo of a food product.
• Is marketed in a manner that uniquely appeals to minors; or
• Uses actual copyrights, service marks, or trademarks or fake copyrights, service marks, or trademarks that resemble consumer or food products popular with minors, including the names of candy or cereal products.

What Happens If I Sell Banned Vapes?

Once a product is added to the NDD Directory, retailers and wholesalers have 60 days to sell or remove it from their inventory. Any products left in circulation will be subject to seizure and destruction.

• Beginning March 1, 2025, manufacturers that sell prohibited products in the state will face a $1,000 daily fine for each such product until it’s removed from the market. This stricture will also apply to retailers, wholesalers and distributors that ship products into the state.

• A person who knowingly sells, ships, or receives for retail sale a prohibited device commits a first-degree misdemeanor. Other violations are enforced by the Attorney General as a deceptive trade practice and are also subject to a civil penalty of $1,000 per prohibited device sold.

• Any person who sells a nicotine product, including vapes, to someone under 21 for a third or subsequent time will face a third-degree felony charge, punishable by up to $5,000 in fines and five years in prison.

What is Not Banned in Florida?

Apart from disposable vapes not listed on the Florida Directory of Nicotine Dispensing Devices (NDD), the Florida law has a carve out and does not include bottled e-liquids, open-system vaping products, and other nicotine dispensing devices that are not prefilled. 

This is a huge breakthrough compared to the FDA's failed and legally challenged Premarket Tobacco Authorization (PMTA) scheme. The PMTA system is a corrupt and textbook display of regulatory capture.

Captured regulators, heavily influenced by both the tobacco industry and Senators bought and paid for with lobbying dollars from nicotine prohibition zealots, have only approved a smattering of obsolete pod systems prefilled with fake tobacco flavored e-liquids manufactured by the tobacco industry.

As a vape reseller, you understand these products have lower margins, are unsustainably expensive for most adults and quite obsolete in 2025. You have seen your customers pushed back into the waiting arms of the tobacco industry, and seen hundreds of your peers put out of work by the ensuing public health carnage. 

Pros and Cons of Florida NDD

Pros: The NDD grants a reprieve to open/refillable vapes. Distorted regulations have made these products less competitive, but this is clearly least wasteful and most efficient way to vape. The good news is that for now disposable vapes with adult appealing artificial flavors are not outright banned. It shouldn’t take a scientist to figure out the many reasons why most combustible cigarette consuming adults are going to prefer an artificial strawberry ice flavor over pathetic fake fauxbacco vape consumed in an obsolete yet expensive Tobacco industry pod kit. 

Cons:  Teen vaping has hit a 10-year low. It is crucial to police any company that is stealing intellectual property for their product. But Kid-friendly is in the eye of the beholder. Enforcing laws against cartoonish packaging is quite reasonable. But the potential is there for abuse by an activist AG office to ban the flavored vapes that adults preferred with minimal pretext. 

 

Is the Banning Process Fair?

On paper, this Florida law is a huge improvement over the typical PMTA Registry law which forces state taxpayers to enforce fatally flawed and corrupt FDA directives that are seemingly designed to destroy the vaping industry and funnel adult nicotine consumers into the arms of the tobacco industry. 

The downside is that the Florida AG is empowered to add products to this list. In theory, an anti-vaping activist AG could wreak havoc by populating the list with products popular with adults. 

 

Problem with Flavor Bans

General public health is not aided by restricting adult access, as vape flavor bans have been shown in myriad studies increase the sale of combustible tobacco products.

Attacks on flavored vapes have been a constant for the US vaping industry, as the vast majority of adult vapor consumers prefer fruit, beverage and dessert flavored vaping products to the fake tobacco flavored e-liquid pods that the FDA has determined were socially acceptable. 

That the Florida legislature has attempted to police what businesses can sell without tossing every popular product off the market with their new law is a step in the right direction.

Without de facto bans on all but tobacco industry cigalike pod products, vaping can thrive as an adult alternative product and remain available in the varieties of flavors and options necessary to sustain both independent businesses and their myriad customers who would otherwise be funneled back onto combustible cigarettes.
