South Carolina Bill S.287 Passed — Urge the Governor to Veto

South Carolina lawmakers have passed S.287, a sweeping vaping regulation bill that would create a state product directory and restrict which electronic nicotine delivery systems (ENDS) can be sold in the state. The bill has now cleared both chambers and is headed to the governor’s desk, where it awaits final action.  

For retailers, distributors, and adult consumers, this is the final opportunity to make their voices heard. 

What S.287 would do 

 

The legislation creates a state-run directory of vaping products that can legally be sold in South Carolina. Only products that meet specific federal premarket requirements—or fall into limited categories under review—would be allowed on the market.  

Key provisions include: 

  • A state directory of approved vaping products 
  • Manufacturer certification requirements 
  • Per-product fees for listing and renewal 
  • Fines for selling products not on the directory 
  • Authority for enforcement agencies to seize non-listed products 
  • A timeline leading to enforcement once the directory is active  

Once the directory is published, products not listed could be removed from shelves and destroyed after a short grace period.  

 

Why this matters 

 

Advocates warn that bills like S.287 often lead to: 

  • Major product shortages for adult consumers 
  • Fewer reduced-risk alternatives to cigarettes 
  • Increased compliance costs for small businesses 
  • Market consolidation that favors large corporations 
  • Growth of illicit or unregulated markets 

Many states that have passed similar registry laws have seen large portions of their legal vapor markets disappear almost overnight. 

 

The final step: the governor’s decision 

 

Because the bill has passed the legislature, the governor now has the power to sign or veto it. 

A veto would stop the bill from becoming law. But that will only happen if the governor hears directly from the businesses, employees, and adult consumers who will be affected.
