Virginia vape retailers have another major compliance deadline approaching. 

Beginning October 1, 2026, businesses selling vapor products and other covered tobacco products at retail in Virginia will be required to hold a new Retail Tobacco Permit issued through Virginia Alcoholic Beverage Control Authority (Virginia ABC). 

Virginia ABC is already accepting applications, and the agency says businesses should expect approximately 20–30 days for online applications to be processed, with paper applications potentially taking longer. With the October 1 deadline approaching, vape retailers should not wait until the last minute to apply.  

Importantly, this new ABC permit is separate from Virginia's existing vapor-product directory and other licensing requirements. For businesses trying to keep track of Virginia's increasingly complicated regulatory structure, here's what the new requirement means. 

 

Who Needs a Virginia ABC Retail Tobacco Permit? 

The new requirement applies broadly to businesses selling covered tobacco products directly to consumers. 

Virginia's definition of a “retail tobacco establishment” includes traditional tobacco and vape shops, convenience stores, grocery stores, gas stations, kiosks, bars, restaurants and facilities making covered delivery sales.  

For the vapor industry, the important point is simple: 

If you sell covered vape products at retail in Virginia, you need to determine whether your location requires this new ABC permit before October 1. 

The statute specifically makes the permit requirement applicable to retail dealers of liquid nicotine and nicotine vapor products, including businesses that may already hold certain licenses or permits through the Virginia Department of Taxation.  

In other words, already having another Virginia tobacco-related license does not necessarily eliminate the new ABC permit requirement. 

 

It's One Permit Per Retail Location 

Businesses operating multiple stores need to pay particular attention to this provision. 

Virginia ABC says a separate Retail Tobacco Permit is required for each retail location.  

A retailer operating ten stores, for example, cannot obtain one company-wide permit and use it across all ten locations. 

Each establishment must go through the permitting process. 

That's particularly important for chains and multi-location operators that need to begin gathering documents and information for multiple applications. 

 

How Much Does the Permit Cost? 

The initial application fee depends on whether the location already holds a Virginia ABC alcohol license. 

For a retailer with an existing ABC license, the application fee is $300. 

For retailers that do not have an existing license to sell alcohol, the application fee is $400. 

The fee is non-refundable and includes the initial 12-month permit.  

For applications approved before October 1, Virginia ABC says the permit will have an effective date of October 1, 2026 and expire September 30, 2027. Permits will then be renewable.  

For independent vape shops without alcohol licenses, that means budgeting $400 per location for the initial permit. 

The Definition Goes Beyond Nicotine 

One of the most significant details for vape retailers is how broadly Virginia defines the products covered by the new retail permitting law. 

The definition includes electronic smoking devices and substances that can be aerosolized or vaporized by those devices, whether or not the substance contains nicotine. It also extends to certain components, parts and accessories.  

Virginia ABC specifically addresses this question in its guidance and states that a permit is required to sell electronic smoking devices even when they do not contain nicotine.  

That's an important distinction from laws that regulate only nicotine-containing products. 

Retailers should therefore be careful about assuming a zero-nicotine product automatically falls outside the new ABC retail permitting system. 

 

What About Manufacturers and Wholesalers? 

The Virginia ABC Retail Tobacco Permit is a retail requirement. 

Virginia ABC states that businesses that only manufacture or wholesale distribute these products are not required to obtain this permit, although other Virginia licenses and permits may apply.  

That's an important distinction because Virginia has multiple regulatory programs operating at the same time. 

Manufacturers, distributors and retail dealers of liquid nicotine and nicotine vapor products can have separate licensing obligations under Virginia tax law. Virginia law also contains specific licensing, recordkeeping and compliance requirements for different levels of the supply chain.  

So, “I don't need the ABC retail permit” does not necessarily mean “I don't need a Virginia license.” 

Businesses need to identify their role in the supply chain and determine which requirements apply to them. 

 

 

What Do Retailers Need to Apply? 

Virginia ABC recommends that applicants begin gathering their documentation before starting the application. 

According to the agency, applicants should be prepared to provide information and documents including: 

• A copy of the business's lease or deed  

• A list of officers, directors or members  

• Virginia State Corporation Commission registration  

• The business's IRS FEIN documentation  

• Relevant agreements or other business documents  

• A state DMV driving record for each owner/member  

Businesses applying online will also need an account in Virginia ABC's Virginia ABC Licensing (VAL) system.  

Virginia ABC strongly encourages online applications because paper applications are expected to take longer to process.

Employee Training Is Part of the New Requirement 

The new law isn't simply a matter of paying a fee and receiving a permit. 

Applicants must attest that employees have received required training covering issues such as age and ID verification, required signage, prohibited conduct and penalties.  

Virginia ABC has created a free training program called VERT — Virginia Education for Retailers of Tobacco — that includes the required training elements.  

This means retailers should begin looking beyond the application itself and make sure their employee training and compliance procedures are ready for October 1. 

 

 

The New Permit Does Not Replace Virginia's Vape Directory 

This point is especially important for vape businesses. 

Receiving a Virginia ABC Retail Tobacco Permit does not mean a retailer can sell any vape product it chooses. 

Virginia's separate liquid nicotine and nicotine vapor product directory remains another layer of compliance. 

Virginia ABC specifically warns businesses selling liquid nicotine or nicotine vapor products that covered products must appear on the Virginia Attorney General's approved product directory.  

Virginia law prohibits the sale, distribution, or importation for resale of covered liquid nicotine and nicotine vapor products that aren't included in the directory.  

So, there are two very different questions a Virginia vape retailer needs to answer: 

Is my business authorized to sell these products? 

And: 

Is this particular product authorized to be sold in Virginia? 

The new ABC permit addresses the first question. The Virginia product directory addresses the second. 

A retailer needs to comply with both applicable requirements. 

 

 

Recordkeeping Is Becoming Even More Important 

The new regulatory structure also gives businesses another reason to tighten up recordkeeping. 

Beginning October 1, retail tobacco permittees handling liquid nicotine or nicotine vapor products must preserve documents relating to their purchase, sale, receipt, exchange or transportation for three years. 

Those records can include invoices, books, papers, canceled checks, and other relevant documentation and may be subject to audit or inspection.  

The law makes failure to comply with the record-retention requirement of a Class 2 misdemeanor, while failure or refusal to cooperate with certain audits, inspections or investigations can trigger a $1,000-per-day penalty.  

For retailers, keeping clean supplier invoices and purchase records is no longer simply good business practice. It is becoming an increasingly important part of Virginia compliance. 

 

What Happens if a Retailer Doesn't Get the Permit? 

The October 1 deadline shouldn't be treated as optional. 

Virginia ABC says that selling covered retail tobacco products after October 1, 2026, without the required permit may result in misdemeanor criminal charges.  

The law also makes the permit holder responsible for violations committed by its employees or agents in connection with their employment.  

That makes employee training, age-verification procedures, and internal compliance policies especially important. 

 

Virginia Vape Retailers Should Start Preparing Now 

October 1 is coming quickly, and Virginia ABC estimates 20–30 days just to process an online application.  

For retailers that haven't started yet, now is the time to determine which locations need permits, create a VAL account, gather corporate and property documents, order the required DMV records, complete employee training and submit applications. 

Multi-location operators should remember that the requirement applies per location, not simply per company. 

And vape businesses need to look at Virginia compliance as a whole rather than treating the new ABC permit in isolation. 

A business may now have to navigate ABC retail permitting, separate tax/licensing requirements, the Attorney General's vapor product directory, employee training, age verification and recordkeeping requirements simply to continue legally selling vapor products in Virginia. 

 

Virginia's Vape Compliance Landscape Is Changing Again 

The new ABC permit adds another layer to an already complicated Virginia market. 

For legitimate vape retailers, the immediate priority is making sure their doors can legally remain open after October 1, 2026. 

But obtaining the permit is only part of that responsibility. Retailers also need to know what's on their shelves, where those products came from, whether they are eligible for sale under Virginia's directory law, and whether employees understand the state's rules. 

With Virginia ABC already accepting applications and warning that processing can take several weeks, waiting until October is a risk businesses don't need to take.
