A major federal policy shift is moving through Congress that could eliminate nearly all commercial hemp-derived products currently available in the U.S. market — including THCa flower, delta-8 THC derivatives, broad-spectrum CBD products, and even in-process manufacturing materials. 

This proposal isn’t theoretical. It’s included in the Senate’s Continuing Resolution (CR) and could pass within days. If enacted, the clock starts ticking—365 days until most hemp products become federally illegal.

Under the Senate language, “hemp” would no longer be defined by delta-9 THC alone. Instead, it would be regulated based on Total THC, explicitly including:

This means hemp could instantly reclassify into federally illegal Schedule 1 marijuana, same as heroin. 

In addition: 

Final products must contain less than 0.4 mg of Total THC per container — an impossible threshold for most CBD and minor cannabinoid goods. 

“Synthetic or manufactured cannabinoids” are banned, regardless of safety or origin. 

“Work in progress” materials are not exempt, crippling the supply chain.
